These Terms of Service ("Terms") govern your access to and use of OpenAlon games, mobile applications, websites, live events, community features, support channels, and related services (collectively, the "Services") made available by OpenAlon ("OpenAlon", "we", "us", or "our").

Some Services may be offered through third-party platforms such as Apple, Google, Steam, console storefronts, social platforms, advertising partners, tournament tools, or customer-support providers. By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Scope of the Services

The Services may include games, gameplay systems, live operations, seasonal or event content, official websites, promotional experiences, social channels, support tools, and other connected products or features that reference these Terms. Certain features may only be available in some regions, platforms, or devices.

2. Eligibility, Accounts, and Access

You are responsible for ensuring that your use of the Services is lawful in your jurisdiction. If you are under the age of majority where you live, you may use the Services only with the involvement or consent of a parent or legal guardian where required by law.

Some Services may require an OpenAlon account, player profile, social login, or platform account. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account or device. Subject to these Terms, OpenAlon grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial entertainment purposes.

4. User Content, Feedback, and Community Features

If you submit messages, bug reports, support requests, screenshots, tournament data, community posts, or other content through the Services, you confirm that you have the rights needed to submit that content and that it does not violate law or third-party rights.

To operate, improve, and promote the Services, you grant OpenAlon a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, publish, display, and distribute such submissions for service-related purposes. Feedback and suggestions may be used by OpenAlon without restriction or compensation.

5. Virtual Items, Purchases, and Subscriptions

Some Services may offer virtual currency, in-game items, battle passes, downloadable content, premium features, event access, subscriptions, or other digital entitlements ("Virtual Items"). Virtual Items are licensed, not sold, and do not have cash value unless applicable law requires otherwise.

Unless required by law or the relevant platform policy, purchases are final and non-refundable. Virtual Items may be modified, removed, limited, expired, or discontinued as part of balancing, live operations, fraud prevention, technical maintenance, or service sunset decisions.

6. Third-Party Platforms, Billing, and Refunds

If you access the Services through Apple, Google, Steam, console platforms, or other storefronts, those providers may control billing, payment processing, subscription management, parental controls, and refund mechanisms. Their terms, policies, and technical limitations apply in addition to these Terms.

OpenAlon is not responsible for third-party platform outages, payment failures, storefront policy changes, or the handling of refunds and chargebacks by those providers.

7. Updates, Live Operations, and Availability

OpenAlon may patch, update, rebalance, localize, remove, or otherwise change the Services at any time. This may include gameplay features, pricing, reward systems, item availability, progression mechanics, competitive rules, live events, and social or support functionality.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. Maintenance, network conditions, moderation actions, legal requirements, or business decisions may affect access.

8. Intellectual Property and Brand Assets

The Services and their contents, including games, software, audiovisual assets, designs, UI elements, code, characters, names, logos, trademarks, music, videos, artwork, promotional assets, and compilations, are owned by or licensed to OpenAlon and are protected by applicable intellectual property laws.

Except for the limited license above, no rights are granted to you. You may not use OpenAlon branding, trade dress, or promotional assets without prior written permission except where applicable law allows.

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, share, retain, and otherwise process information related to the Services.

10. Suspension and Termination

OpenAlon may investigate misuse of the Services and may suspend, restrict, disable, or terminate access where we reasonably believe it is necessary to protect players, maintain fair play, prevent fraud, address abuse, comply with law, enforce these Terms, or protect the integrity of the Services.

You may stop using the Services at any time. Upon suspension or termination, some content, saved progress, Virtual Items, or access rights may become unavailable, subject to applicable law and platform policy.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, quiet enjoyment, or uninterrupted operation.

12. Limitation of Liability

To the maximum extent permitted by law, OpenAlon and its affiliates, officers, directors, employees, licensors, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunities, saved progress, or Virtual Items arising from or related to the Services.

To the extent liability cannot be excluded, OpenAlon's aggregate liability for claims relating to the Services will not exceed the greater of the amount you paid us for the relevant Service during the 12 months before the claim arose or the minimum amount required by applicable law.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless OpenAlon and its affiliates, officers, directors, employees, licensors, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of your misuse of the Services, your breach of these Terms, or your violation of law or third-party rights.

14. Disputes and Governing Law

Unless mandatory law in your jurisdiction provides otherwise, these Terms are governed by the laws applicable to the operator of the relevant Service, without regard to conflict of law principles. Unless mandatory consumer law says otherwise, disputes relating to the Services will be brought before the courts with jurisdiction over the operator's principal place of business.

Nothing in these Terms limits non-waivable consumer protections, privacy rights, withdrawal rights, warranty rights, or local remedies available to you under applicable law.

15. Regional Consumer Rights

If you live in the EEA, United Kingdom, Switzerland, California, or another jurisdiction with specific consumer or privacy protections, additional mandatory rights may apply to purchases, renewals, dispute resolution, data use, and cancellation. These Terms operate only to the extent permitted by those laws.

16. Severability and Waiver

If any part of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law. A failure to enforce any provision is not a waiver.

17. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted with a revised effective date, and material changes may be communicated through the Services or by other reasonable means where appropriate. Your continued use of the Services after updated Terms become effective means you accept the revised Terms.
